Release of Liability
I understand that there are risks of physical injury associated with, arising out of and inherent to the activity of dance. In recognition of this acknowledged risk of injury, I knowingly and voluntarily waive all right and/or causes of action of any kind, including any and all claims of negligence arising as a result of such activity from which liability could accrue to Dance Movement Inc., its officers, agents, employees, instructors and all affiliated entities (hereinafter collectively referred to as “DMI”).
I hereby agree to release DMI and hold DMI harmless of all liability and hereby acknowledge that I knowingly and voluntarily assume full responsibility for all risks of physical injury arising out of active participation in dance activities. I am aware that this is a release of liability and an acknowledgement of my voluntary and knowing assumption of the risk of injury. I have signed this voluntarily and of my own free will in exchange for the privilege of participation.
Terms and Conditions
- Application
of these Terms and Conditions
a)
These “Terms and Conditions”, as operated by
Dance Movement Inc Pte Ltd (“DMI”), shall govern your relationship with DMI,
including but not limited to, the use of the DMI Website
(www.dancemovementinc.com, the “Website”) and the DMI OClass App (the “App”) to
manage your account, bookings, communication, purchases and registration with
DMI, as well as the use of and attendance at DMI Studio.
b) By
your attendance at DMI and usage of the Website, App, and facilities, you
signify your acceptance of the Terms. If you do not agree to this, please
refrain from using the Website or App, purchasing a DMI class, booking a DMI
class, and/or using or attending a DMI class.
c)
DMI has the rights to amend this information
without notice. The Terms may be revised at any time by updating this URL. DMI
clients are encouraged to check this document periodically to stay informed of
current guidelines.
- Privacy
Policy
a)
DMI is committed to maintaining the security and
confidentiality of the personal information held by us. This Privacy Policy
describes how we look after the personal information we obtain or you provide
us with when you use the Website and the App when you sign-up for our Classes.
b) We
will take reasonable care to ensure that your personal information is accurate,
complete, up-to-date and stored in a secure environment, protected from
unauthorised access, modification, loss or disclosure.
c)
Personal Information
i.
“Personal Information” refers to your personal
particulars obtained by us in the course of our dealings with you.
ii.
Such personal information includes your use of
our products and services, name, mailing addresses, phone number, email
addresses, service details, payment details and credit history. Through
“cookies”, it might also include how you use our Website to help us develop and
improve our website, including details of your domain name and Internet
Protocol (IP) address, operating system, browser version, cookie details, how
long you stayed on a page, the route you took to navigate through the pages and
the website that you visited prior to accessing our site.
iii.
We collect your personal information from you,
from third parties such as credit reporting agencies and from our own systems.
d) How
we Use your Personal Information
i.
Collecting Personal Information helps us better
understand what you need from us.

We may collect and use your Personal Information
to:
i.
verify your identity;
ii.
plan, provision and bill for products and
services;
iii.
provide access to, personalise your experience
on, and improve the functionality of our Website and App;
iv.
manage your relationship with customer care
related activities and technical assistance;
v.
notify you with details of products, services,
special offers and rewards that we think will be of interest to you;
vi.
carry out market and product analysis to improve
our products and services and the marketing of our products and services;
vii.
gather feedback and statistics to improve our
network, servers, Website and App;
viii.
improve your user experience through profiling
and analysing your preferences;
ix.
manage bad debt and prevent fraud or illegal
activities;
x.
carry out activities connected with running of
our business (such as personnel training, quality control, dispute resolution,
and network monitoring) and in connection with the transfer of any part of our
business in respect of which you are a customer or potential customer;
xi.
investigate any action that may threaten network
security or integrity;
xii.
complying with any applicable law, regulations,
guidelines or rules or to render assistance to law enforcement, governmental
and regulatory agencies;
xiii.
provide complementary products or services, or
rewards to you from our business partners; and
xiv.
other related purposes.
xv.
DMI will not use your Personal Information for
any purpose not permitted by law or beyond the stated purpose you have
consented to.
xvi.
The DMI Website may contain links to other
sites. We are not responsible for the privacy practices or the content of such
Websites.
f)
From time to time, we use other third parties to
perform obligations related to the provision of our products or services. Those
entities may include:
i.
Companies related to us;
ii.
Our business partners, marketing partners and
authorised service providers;
iii.
Credit providers or credit reporting agencies;
and
iv.
Law enforcement, governmental and regulatory
agencies
g)
We are required to disclose your Personal
Information to the parties described above so that they may carry out their
obligations to us, and to you. Our disclosure of your Personal Information may,
at times, be subject to their privacy policies. To every extent possible, we
require these parties to act consistently with the personal information
protections we have put in place.
h.
How you can access and update your Personal
Information
i.
You can access, correct or update your listed
customer details by logging in to your DMI accounts through the Website or App.
ii.
If you require access or a copy of your Personal
Information within our possession, please contact us at
join@dancemovementinc.com and we will assess your request. In some cases, we
may impose a reasonable charge for making copies of Personal Information
available to you. If so, we will advise you of the charge prior to making the
information available to you.
iii.
If you wish to request for the removal of
Personal Information we hold, together with the deletion of your account,
please contact us at join@dancemovementinc.com. Our compliance to your request
for the removal of your Personal Information is subject to any applicable legal
or business requirements to retain certain records of your Personal
Information. Please note that removal of Personal Information may result in
limited or no access to the service that we provide.
- Class
Registration
a)
Existing students must register and make
relevant payment for a class on the Website or App before attending
classes.
b) Completely
new students may register and make relevant payment in person at our front desk
or by contacting the studio through official channels.
c)
Male to Female ratio of partnerwork classes are
set at 50%/50% of class capacity.
d) We
highly recommend that you plan to be at the studio fifteen (15) minutes before
the start of your class, to allow for any travel challenges, to check in and be
“dance-ready”.
- Class
Cancellation
a)
You may cancel your class booking without
charges or credit penalties up until eight (8) hours prior to class
commencement time.
b) Should
you cancel your class booking with less than eight (8) hours to class
commencement, or simply not show up for the class, your class credit will be
forfeited if you’re on a Credit Pack; or a late cancellation/no show fee of $15
if you’re on an All-Access Unlimited Pass.
c)
You may cancel your class booking through the
DMI App, in person at our front desk or by contacting the studio through
official channels.
d) If
the minimum number of students for a class is not reached eight (8) hours
before class starts, the class will be cancelled and all students who have
registered for the class will be notified and have their credits returned
.
- Novice
Courses
a)
Novice courses are progressive introductory
classes intended for complete beginners of that particular dance style.
b) Purchase
of Novice Courses can be made either on the App on in person at our front
desk.
c)
To make the most of your time with us, DMI
strongly encourages students to attend each class of the Novice Course
consecutively. In the case that you are unable to attend a particular class in
your Novice Course, with validity of 60 days, you are permitted to attend the
same class in another Novice Course series of the same dance style.
- Credit
Packs
a)
Purchase of Credit Packs can be made either on
the App or in person at our front desk.
b) Credit
Pack expiry count-down begins on the date of your first class attended using
your Credit Pack.
c)
Extension of validity period is not permitted
unless under the following circumstances:
i.
In the event of an illness, pregnancy or injury,
where proof of condition is produced.
ii.
Expired credits will have their validity
refreshed to the expiry date of the newly purchased Credit Pack. Refreshing of
expired credits is only applicable if the new Credit Pack is purchased within
60 days of the previous Credit Pack expiring.
iii.
Purchase of Credit Packs are final and
non-refundable.
d)
Transferring of credits:
i.
A one-time transfer per Credit Pack may be done
with a one-time administrative fee of $25.
ii.
Transfers can only be done before the expiration
date of the Credit Pack.
iii.
The validity of the transferred credits will not
restart. If the receiving party does not have an existing Credit pack, the
expiry date will remain as it is. If the receiving party has an existing Credit
Pack, the expiry of the receiving party’s summed credits will be extended by
the number of days remaining in the transferred credits’ validity.
iv.
No partial transfers are permitted.
- All-Access
Unlimited Pass (“Pass”)
a)
Purchase of the Pass can be made either on the
App or in person at our front desk.
b)
Start date of your Pass is on the date of your
first class attended using your Pass.
c)
Freezing of your Pass:
i.
Freezing of your Pass may be done with a
one-time administrative fee of $25 paid upfront for each time your Pass is
frozen.
ii.
Freeze duration needs to be stated upfront.
iii.
Requests to Freeze your Pass must be made in
person at our front desk or by contacting the studio through official channels
d)
The maximum duration a pass can be freezed for
are as follows:
i.
4-weeks Pass – 7 days
ii.
12-weeks Pass – 21 days
iii.
24-weeks Pass – 45 days
e)
Purchase of Passes are final, non-refundable and
non-transferable to another person.
- Late
Arrival or Early Departure
a)
To avoid disruptions to the class, you are
discouraged from leaving the studio before the end of the class.
b)
If you arrive late to a class or choose to
depart a class early, your credit will not be returned.
- Retail
and Merchandise
a)
All retail and merchandise sales are
non-refundable.. All merchandise may be exchanged within seven (7) days of the
initial purchase date, as long as the product is unused, and with all
tagging still intact.
- Lost
or Damaged Personal Property
a)
DMI studio provides storage/lockers to house
your personal belongings when class is in session. DMI also maintains CCTV at
common studio areas. Regardless of efforts taken to avoid loss, DMI is not
liable or responsible for any damage, theft, loss, or destruction of personal
property within the DMI studio.
- Waiver
and Release
a)
At DMI, we prioritise the comfort, well-being
and growth of our members. Our instructors may offer hands-on assistance during
classes to help members improve on their techniques, broaden their dancing
skillset, and ensure safety and comfort for all students. These hands-on
assistance are always optional and are performed with the utmost care and
respect for each individual’s boundaries. We encourage open communication
between instructors and members. If at any time you prefer not to receive
hands-on assistance, you are encouraged to inform the instructor, and
alternative guidance will be provided. By participating in our classes, members
acknowledge and consent to the possibility of receiving hands-on assistance,
understanding that they are offered with the intention of enhancing the overall
dancing experience.
b)
By signing up for and/or attending classes,
events, activities, and other programs and using the premises (individually
and/or collectively, the “Classes and Facilities”) of DMI, you hereby
acknowledge on behalf of yourself, your heirs, personal representatives and/or
assigns, that there are certain inherent risks and dangers in dancing at DMI.
You acknowledge that some of these risks cannot be eliminated regardless of the
care taken to avoid injuries and that DMI and the DMI Team will not be liable
for any injury or damage should you choose to participate.
- Dispute
Resolution
a)
At DMI, we do our best to make sure you have a
great experience every time. Whenever someone purchases a DMI Credit Pack or
All-Access Unlimited Pass, we feel indebted to that individual by way of
excellent service. We do acknowledge that from time to time, our expectations
don’t align. Should this happen, we hope you will give us the opportunity to
try to address any challenge you may be facing at DMI. To do that, please
e-mail us at join@dancemovementinc.com.
Please include: (1) your name, (2) a description of your concerns, and (3) a
description of the specific relief you seek.
- Intellectual
Property Rights
a)
The trademarks of DMI are proprietary to DMI and
may not be used by you for any reasons other than as expressly permitted by
these Terms. All Website and App content, design, text, graphics, and
interfaces; the collection, selection, and arrangement thereof; and all
software are property of, or duly licensed to, DMI. You have the right to view,
electronically copy, and print in hard copy portions of the Website and App for
the sole purpose of making class reservations, purchases, or other personal
use.
b)
Any other use of materials on the Website, App,
and in class content, including modification, distribution, or reproduction for
purposes other than those noted above, without the prior written permission of
DMI, is strictly prohibited.
- Warranty
Disclaimer and Limitation of Liability
a)
In no event will DMI be liable for any direct,
indirect, special, or other consequential damages resulting from your use of
the Website, the App, or on any other linked/third-party website, your purchase
of DMI classes, your booking of classes, your purchase of merchandise, your
communication with DMI, and your use of and attendance at DMI’s studios,
including without limitation, any lost profits, business interruption, loss of
programs, or other data on your information handling systems or otherwise, including
any claims waived by you previously in this agreement even if DMI expressly
advised of the possibility of such damage.
b)
All information, goods, services, products and
experiences are provided by DMI on an “as-is” basis only. The entire
risk as to the quality and performance of the goods, services, products and
experiences remains with you. Should the goods, services, products and/or
experiences prove defective after purchase, you assume the entire cost of such
defect. DMI provides no representations and warranties, express or implied,
including the implied warranties of fitness for a particular purpose, merchantability,
and non-infringement.
c)
By agreeing to the terms and conditions, you are
consenting to the use of your images in marketing and promotional materials.

of Law
a)
The Terms are governed by the laws of Singapore.
